I found the line in the Clarity Act written for XRP. It’s on page 2.
The Senate Banking Committee dropped the full PDF of the Digital Asset Market Clarity Act this morning. Markup is scheduled for Thursday, May 14, at 10:30am.
Page 2, Section 105 exists because of XRP, and it is the most important sentence in US crypto legislative history.
It is our court win, the Analisa Torres ruling that retail trades of XRP are not securities transactions, becoming enshrined into law.
“This section also prevents the SEC from determining that a digital asset is a security if, prior to enactment, a US court determined (in a non-appealable judgment) that the digital asset was not a security.”
This takes Torres’ judgment and bolts it into federal statute, where no future SEC chair can ever re-litigate it.
XRP created those words, and they are on their way to Trump’s desk soon.
Of course, the SEC and CFTC have already jointly designated XRP by name as a Digital Commodity. This is just icing on the cake.
